CUT AWAY FROM TRAIN LEAVING THE UP5150 AND UP9524 IN TRACK 6 ON MTUPX 12. RETURNED TO MP 988 AND MADE JOINT ON THE MKSTU 12 AT 1557HRS. CLAIM 130 MILE BASIC DAY FOR HOSTLING POWER NOT IN CONNECTION WITH TRAIN AS PER PLB#5912, CASE#125, AWARD 125.

(1) IF THE CREW IS SENT OUT OF THE TERMINAL FOR AN ADDITIONAL PATCH AFTER HAVING WORKED 100 MILES.

(2) IF THE CREW IS SENT BEYOND 25 MILES TROM THE TERMINAL FOR ANY OF THE PATCHES. (DOES NOT MEAN ALL AFTER, ARE 130 MILES)

(3) IF THE CREW IS REQUIRED TO LEAVE THE TERMINAL AFTER EIGHT HOURS ON DUTY TO MAKE AN ADDITIONAL PATCH.

CLAIM A 130 MILE DAY UNDER THE PROVISIONS OF THE 1976 TRAINMEN'S AGREEMENT, ARTICLE 15, SECTION A, WHICH SPECIFIES TRAINMEN WILL NOT BE SENT OUT OF THE INITIAL TERMINAL AFTER "EIGHT CONSECUTIVE HOURS, EXCEPT AS A NEW DAY.”

NOTE 2:  UP IS CURRENTLY DEDUCTING TIME SPENT WITHIN THE 25 MILE ZONE FROM OVERTIME.  THERE IS NO LANGUAGE IN THE TUCSON HUB AGREEMENT TO SUPPORT THIS DECUCTION OF OVERTIME.  CLAIMS FOR ALL OVERTIME DEDUCTED SHOULD BE PROCESSED AS WELL.

   

TO CLAIM OVERTIME BACK:

CLAIM THE (TOTAL AMOUNT) OF OVERTIME DEDUCTED FROM PAY FOR WORKING THE (TRAIN ID), WITHIN THE 25 MILE ZONE.  CALLED ON DUTY AS (POSITION) FROM (BOARD/POOL, SPACE), THE (TRAIN ID, WITH ENGINE #) AT (LOCATION, CIRC-7, MP) WITHIN THE LIMITS OF THE 25 MILE ZONE, AT (DATE & TIME) FOR A TOTAL TIME ON DUTY OF (TOTAL) CREW TIED UP IN (TERMINAL, CIRC-7) AT (TIME).  THE TIME THE CREW SPENT IN WITHIN THE 25 MILE ZONE, WAS IMPROPERLY DEDUCTED FROM THE OVERTIME FOR THIS DATE.  THERE IS NO PROVISION IN THE TUCSON HUB AGREEMENT FOR THIS TYPE OF DEDUCTION.

GENERAL - COMPUTATION OF DIFFERENCE OF EARNINGS

THE PERIOD FOR COMPUTING DIFFERENCE IN EARNINGS IN TRAIN SERVICE WITH EXCEPTIONS IN (A) AND (B) BELOW EXTENDS FROM THE TIME THE INDIVIDUAL GOES ON DUTY AT THE HOME TERMINAL (FIRST SERVICE PERFORMED BY HIM/HER SUBSEQUENT TO THE TIME BOTH HE/SHE AND HIS/HER ASSIGNMENT WERE AT THE HOME TERMINAL TOGETHER) UNTIL THE TIME THE INDIVIDUAL ARRIVES BACK AT THE HOME TERMINAL AND HIS/HER ASSIGNMENT IS AT THE HOME TERMINAL. IN ADDITION, DIFFERENCE IN EARNINGS COMPUTATION ENDS THE LAST DAY OF EACH MONTH, AND A NEW CYCLE STARTS ON THE FIRST DAY OF THE SUCCEEDING MONTH, IRRESPECTIVE OF WHETHER IT WOULD HAVE OTHERWISE CEASED ON THATDATE.

 

IN CASES WERE AN INDIVIDUAL'S ASSIGNMENT DOES NOT WORK ON THE DATE SUCH INDIVIDUAL IS INITIALLY USED OFF HIS/HER ASSIGNMENT FOR OTHER SERVICE, HIS/HER EARNINGS THAT DATE CANNOT BE USED TO COMPUTE DIFFERENCE INEARNINGS.

 

IF AN INDIVIDUAL IS USED OFF HIS/HER ASSIGNMENT IN OTHER SERVICE AND IS AT THE HOME TERMINAL ON A DATE ON WHICH HE PERFORMS NO SERVICE WHILE HIS/HER ASSIGNMENT PERFORMS SERVICE ON THAT DATE, THE EARNINGS OF HIS/HER ASSIGNMENT THAT DATE CANNOT BE USED IN COMPUTING DIFFERENCE INEARNINGS.
