SWITCHMAN (NAME) BEHIND ME ON THE EXTRA BOARD WAS CALLED AND WORKED THE ASSIGNMENT. I WAS NOT CALLED DURING THIS SHIFT RANGE. CREW DISPATCHER ERROR RESULTED IN MISHANDLING OF EXTRA BOARD. I WAS DETACHED FROM MY CREW AT (TIME) BY YARDMASTER (NAME) AND REQUIRED TO PERFORM SERVICE ON ANOTHER CREW (TRAIN ID & UNIT#) WHILE THE REMAINDER OF MY CREW CONTINUED WORKING. I WAS INSTRUCTED TO LINE (TRAIN ID) OUT OF (OR INTO TRACK #) TOWARDS MAINLINE OR YARD (TRACK #) (IN ROSEVILLE ADD USING ELECTRIC SWITCHES AT THE KIOSK). I WAS ASSIGNED TO THIS CREW FROM (TIME) TO (TIME) UNTIL (TRAIN ID) DEPARTED/ARRIVED. DURING MY ABSENCE MY CREW CONTINUED THEIR PREVIOUSDUTIES.

AT (TIME) WE WERE INSTRUCTED BY YARDMASTER/MANAGER (NAME) TO REDUCE 1 CAR (CAR # OR #’S) OFF OF TRACK (TRACK #) IN RECEIVING YARD. THE ROAD CREW OF THE (TRAIN ID) HAD LEFT SAID CAR(S) OUT TO FOUL. THE ROAD CREW HAD SUFFICIENT TIME UNDER THE HOURS OF SERVICE ACT TO PROPERLY YARD TRAIN UNDER OUTSTANDING YARD INSTRUCTION. THE ROAD CREW DID NOT EXPIRE UNTIL(TIME).

FAMILIARIZATION – ARTICLE IX

 

Q.  ARE THERE A SET NUMBER OF TRIPS THAT AN EMPLOYEE WILL TAKE IN LEARNING NEW TERRITORY?

A.  NO, SINCE EMPLOYEES HAVE DIFFERING EXPERIENCES THE NUMBER OF TRIPS WILL VARY AND THE LOCAL CHAIRMEN WILL WORK WITH LOCAL OPERATING ON THE NUMBER AND TYPE OF TRIPS NEEDED.

Q.  AN EMPLOYEE WHO MAKES FAMILIARIZATION TRIPS ONLY ON THE PORTION OF THE GEOGRAPHIC TERRITORY WHERE HE INTENDS TO WORK MAY LATER EXERCISE SENIORITY OR BE FORCED TO ANOTHER PART OF THE TERRITORY WITH WHICH HE IS NOT FAMILIAR.  DOES THIS AGREEMENT APPLY TO THE NECESSARY ADDITIONAL FAMILIARIZATION TRIPS?

 

A.  YES, NO MATTER HOW MUCH TIME HAS ELAPSED FROM DATE OF IMPLEMTATION OF THIS AGREEMENT.

Q.  WHO WILL APPROVE AN EMPLOYEE AS BEING PROPERLY FAMIARIZED ON A NEW TERRITORY?

 

A.  CARRIER OFFICER.

 

Q.  IF AN UNQUALIFIED EXTRA EMPLOYEE STANDS FIRST OUT FOR AN ASSGINMENT AND THE NEXT EXTRA EMPLOYEE IS QUALIFIED, MAY THE FIRST EXTRA EMPLOYEE BE RUN-AROUND?

 

A.  NO; HOWEVER, THE CARRRIER WILL ATTEMPT TO PLACE EMPLOYEES UNFAMILIAR WITH EXTRA BOARD ASSIGNMENTS ON FAMILIARIZATION BOARD (PAID THE SAME AS IF ON THE EXTRA BOARD) TO LEARN THE AREA PRIOR TO MARKING UP ON THE EXTRA BOARD. IF THE ABOVE HAPPENS, THEN THE CARRIER MAY CALL THE NEXT OUT EMPLOYEE TO BE A PILOT, USE A QUALIFIED OFFICER TO RIDE WITH THEM OR USE ONE OF THE PEER TRAINING EMPLOYEES.

 

Q.  IF THE NEXT OUT EMPLOYEE IS USED AS A PILOT, HOW SHALL THEY BE COMPENSATED?

THE CARRIER VIOLATED THE MANDATORY PROVISIONS OF THE CURRENT YARD AGREEMENT BY NOT AFFORDING OUR CREW A PROPER MEAL PERIOD WITHIN THE PRESCRIBEDTIME.

SECTION(A). YARD CREWS WILL BE ALLOWED 20 MINUTES FOR LUNCH BETWEEN 4 ½ AND 6 HOURS AFTER STARTING WORK WITHOUT DEDUCTION  IN  PAY.     SECTION (B). YARD CREWS WILL NOTBE REQUIRED TO WORK LONGER THAN 6 HOURS WITHOUT BEING ALLOWED 20 MINUTES FOR LUNCH, WITH NO DEDUCTION IN PAY OR TIME THEREFOR.

 

QUESTION: IF A YARD CREW, THROUGH SOME UNFORSEEN CIRCUMSTANCES, BE ON DUTY SAY TWELVE HOURS, WOULD THE CREW BE ENTITLED TO A SECOND PERIOD OF TWENTY MINUTES IN WHICH TO EAT, AND IF SO, WHEN WOULD IT BEGIN?

 

ANSWER: PARAGRAPH (B) APPLIES TO BOTH THE FIRST AND SECOND LUNCH PERIODS.CREW WOULD BE ENTITLED TO SECOND LUNCH PERIOD SIX HOURS AFTER COMPLETING THE FIRST LUNCH PERIOD. IN EITHER CASE, SWITCHMEN WILL NOT BE WORKED LONGER THAN SIX HOURS WITHOUT BEING GIVEN AN OPPORTUNITY TO EAT.

AS OF APRIL 1, 2018, ACCORDING TO THE YARD AGREEMENT MODIFICATION SWITCHMAN BUT BE IN THE YARD MAJORITY OF THE TIME BETWEEN APRIL 1 THROUGH SEPTEMBER 31 TO QUALIFY FOR YARD PERSONAL LEAVE DAYS. FURTHERMORE, IF YOU DO NOT QUALIFY FOR VACATION TIME, YOU DO NOT QUALIFY FOR PERSONAL LEAVE DAYS.

YARD VACATION HOLD DOWN RULES

 

THE FOLLOWING PROCESS FOR MAKING HOLD DOWNS HAS BEEN IN EFFECT FOR A TRIAL PERIOD IN SEVERAL YARDS SINCE JANUARY 16, 2006. THE ORIGINAL PILOT PROJECT HAS EVOLVED AND IS NOW AVAILABLE IN ITS CURRENT FORM IN EVERY YARD ON THE FORMER SOUTHERN PACIFIC WESTERN LINES.

IN ORDER TO MAINTAIN A CONSISTENT APPLICATION, THE FOLLOWING PROCEDURES WILL APPLY.

 

1) VACATION VACANCY ONLY REGULAR OR EXTRA SWITCHMAN MAY MAKE A HOLD DOWN AND ONLY ON A KNOWN VACATION VACANCY OF 7 DAYS OR MORE AFTER THE VACATION HAS STARTED. SUCH SWITCHMAN MAKING A HOLD DOWN MUST REMAIN ON THAT HOLD DOWN UNTIL THE VACATION ENDS (UNLESS DISPLACED FROM THE HOLD DOWN) AT WHICH TIME THE SWITCHMAN WILL BE RETURNED TO HIS/HER OWN ASSIGNMENT.

 

2) HOLD DOWN VACANCY (CURRENTLY TV STATUS) REGULAR OR EXTRA SWITCHMAN MAY MAKE A HOLD DOWN ON A KNOWN VACANCY OF ANOTHER REGULAR SWITCHMAN WHO IS IN TV STATUS DUE TO WORKING A HOLD DOWN ON ANOTHER REGULAR ASSIGNMENT.

 

3) MULTIPLE HOLD DOWNS A SWITCHMAN WHO IS ON A HOLD DOWN WILL NOT BE ALLOWED TO EXERCISE SENIORITY TO ANOTHER HOLD DOWN OR ANOTHER REGULAR ASSIGNMENT.

 

4) DISPLACING A SWITCHMAN WHO IS ON A HOLD DOWN A SENIOR SWITCHMAN MAY DISPLACE A JUNIOR SWITCHMAN FROM A HOLD DOWN ONLY ON THE JOBS WORK DAYS (AT LEAST 4’ PRIOR TO ON DUTY TIME TO WORK THAT SAME DAY). NO DISPLACEMENTS WILL BE ALLOWED ON THE JOBS DAYS FRIDAY OR DAYS OFF.  THE SWITCHMAN MAKING SUCH DISPLACEMENT WILL BE PLACED ON THE HOLD DOWN IMMEDIATELY. THE SWITCHMAN DISPLACED WILL BE NOTIFIED BY CMS AS SOON AS POSSIBLE.

 

5) RELEASED FROM A HOLD DOWN ON A VACATION VACANCY SWITCHMEN WHO ARE ON A HOLD DOWN ON A VACATION VACANCY WHO ARE RELEASED AT THE EXPIRATION OF THE VACATION WILL RETURN TO THEIR OWN ASSIGNMENT AND NO NOTIFICATION WILL BE NECESSARY.

 

6) RELEASED FROM A HOLD DOWN ON A NON-VACATION VACANCY

SWITCHMEN ON A HOLD DOWN ON A NON-VACATION VACANCY WILL BE NOTIFIED AS SOON AS POSSIBLE WHEN RELEASED FROM A HOLD DOWN (EITHER BY BEING DISPLACED OR BY INCUMBENT RETURNING) AND WILL BE RETURNED TO THEIR REGULAR POSITION. SWITCHMEN ON A HOLD DOWN MUST BE AVAILABLE DURING CALLING TIMES OF BOTH THEIR OWN ASSIGNMENT AND THE ASSIGNMENT THEY ARE HOLDING IN THE EVENT CMS HAS BEEN UNABLE TO NOTIFY THEM OF BEING RELEASED.

A.  NO, THE SWITCHMAN HAS TO BE ON A REGULAR ASSIGNMENT OR ON THE EXTRA BOARD.

 

Q.  WHAT ARE THE TIME LIMITS FOR DISPLACING A JUNIOR SWITCHMAN OFF OF A HD?

A.  DISPLACEMNT OF HD CAN BE DONE ANYTIME WHILE JOB IS ON DUTY BUT NOT LATER THAN 4 HRS (OR BEFORE CALLING TIME) PRIOR TO THE ON DUTY TIME FOR THE ASSIGNMENT.

 

Q.  WILL SWITCHMEN RELEASED FROM HD BE RETURNED TO THEIR REGULAR ASSIGNMENT PRIOR TO BEING NOTIFIED?

 

A.  YES, WHEN DISPLACED OR RELEASED FROM HD, SWITCHMEN WILL BE RETURNED TO THEIR OWN ASSIGNMENT OR EXTRA BOARD AND CMS WILL ATTEMPT TO NOTIFY THEM.  SWITCHMENT MUST BE AVAILABLE DURING CALL TIMES OF THE HD & REGULAR ASSIGNMENT FOR NOTIFICATION.

 

Q.  WILL EXTRA SWITCHMEN RELEASED FROM HD BE REQUIRED TO ACCEPT A CALL DURING NEXT CALL TIMES?

 

A.  YES, THEIR ASSIGNMENT IS THE EXTRA BOARD AND IF RETURNED TO THE EXTRA BOARD THEY WIOULD BE REQUIRED TO PROTECT ALL 3 CALL TIMES.

 

Q.  HOW WILL A SWITCHMEN WORKING A VACATION VACANCY BE HANDLED?

 

A.  SWITCHMEN WORKING VACATION VACANCY MUST BE AWARE OF THE DATE OF RETURN OF REGULAR SWITCHMEN AND KNOW THAT HE WILL BE RETURNED TO HIS REGULAR ASSIGNMENT AND THE END OF THE VACATION PERIOD.  HE WILL NOT BE NOTIFIED AND WILL BE REQUIRED TO PROTECT HIS REGULAR ASSIGNMENT IF RESTED.
